Welcome to Harmonia Pilates. These Terms of Service (“Terms”) govern your access to and use of harmoniapilates.co, any related pages, booking platforms, applications, digital services, and other online services operated on behalf of Harmonia Pilates LLC (collectively, the “Site”), as well as purchases made through the Site. Harmonia Pilates LLC (“Harmonia Pilates,” “Harmonia,” “Company,” “we,” “us,” or “our”) operates a Pilates studio located at: Harmonia Pilates LLC, 5809 Geary Blvd, San Francisco, CA 94121. Please read these Terms carefully. By accessing or using the Site, creating an account, booking a class, or purchasing a product or service through the Site, you agree to these Terms and our Privacy Policy. Certain services, including memberships, recurring plans, studio participation, special programs, or events, may also be governed by additional agreements, waivers, policies, or purchase terms. If there is a conflict between these Terms and a specific membership or purchase agreement, the specific agreement will control with respect to that service. If you do not agree to these Terms, please do not use the Site.

1. Eligibility — You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or purchase Services unless a parent or legal guardian completes the transaction on your behalf. Participation by minors in studio activities is permitted only when offered by Harmonia and when any required parent or guardian consent, waiver, or other documentation has been completed.

2. Our Services — Harmonia Pilates provides Pilates, movement, strength, fitness, and related wellness services. Our offerings may include group Pilates classes; private or semi-private sessions; workshops or special events; memberships; class packages; drop-in classes; introductory offers; retail merchandise; digital or educational content; and other fitness or wellness-related services we may offer from time to time. Class schedules, instructors, equipment, programming, hours, pricing, and availability may change. We may substitute instructors, modify a class format, adjust the schedule, or temporarily change or discontinue a particular class or service when reasonably necessary.

3. Accounts — Certain features of the Site or our booking platform may require you to create an account. You agree to provide accurate and current information and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. Please notify us promptly at info@harmoniapilates.co if you believe your account has been accessed without authorization. You may not use another person’s account without permission or create an account using false information.

4. Physical Activity and Assumption of Risk — Pilates, strength training, exercise, and physical movement involve inherent risks, including muscle soreness, strains, sprains, falls, aggravation of existing conditions, equipment-related injuries, cardiovascular events, serious bodily injury, and, in rare circumstances, death. Your physical abilities, limitations, health conditions, and medical circumstances are personal to you. Before participating, determine whether activity is appropriate for you and consult a qualified healthcare professional when you have concerns. If you are pregnant, postpartum, recovering from surgery or injury, receiving medical treatment, or have a condition that may affect safe exercise, consult your healthcare provider. Communicate relevant physical limitations to your instructor and stop exercising and seek appropriate assistance if you experience significant pain, dizziness, faintness, unexpected shortness of breath, or other concerning symptoms.


5. Participant Waiver — Participation in in-person classes, private sessions, workshops, events, or other physical activities may require separate acceptance of Harmonia’s Participant Waiver, Release, and Assumption of Risk Agreement. These Terms do not replace that agreement. Participation may be prohibited until all required documents are completed.


6. No Medical Advice — Harmonia provides fitness and movement instruction, not medical care, physical therapy, diagnosis, treatment, nutritional therapy, or individualized medical advice unless expressly stated and provided by an appropriately licensed professional. Information from the Site, instructors, social media, emails, or other communications is for general fitness and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. We do not guarantee particular fitness, weight-loss, strength, appearance, health, rehabilitation, or other results; individual results vary.

7. Class Reservations — Advance reservations may be required and are subject to availability. You are responsible for ensuring reservation details are correct. Class availability is not guaranteed simply because you purchased a membership or class package, and some classes may have eligibility, experience, age, or participation requirements.


8. Cancellations, Late Cancellations, and No-Shows — Reservations are subject to the cancellation policy displayed through our booking system or communicated at booking. If you cancel after the deadline or fail to attend, you may lose the class credit, be charged a late-cancellation or no-show fee, or be subject to another disclosed consequence. Harmonia may waive a fee or restore credit in its discretion; doing so once does not require us to do so again. Nothing limits cancellation or refund rights that cannot legally be waived.

9. Late Arrival — Clients should arrive with sufficient time to begin safely. Harmonia may decline entry to a client who arrives after class begins; a resulting denied entry may be treated under the applicable late-cancellation or no-show policy.

10. Purchases — Prices are displayed before purchase in U.S. dollars unless indicated otherwise, and applicable taxes may be added where required. By submitting payment information, you represent that you are authorized to use the payment method and authorize Harmonia and its processor to charge the applicable amount. We may correct pricing or clerical errors before completion.


11. Class Packs and Drop-In Classes — Class package quantity, price, expiration, transferability, and other material terms are disclosed at purchase. Unless stated otherwise or required by law, packages are for personal use, may not be resold, unused credits expire as disclosed, and purchases are non-refundable after applicable statutory or other refund rights expire. Promotional and introductory packages may have different terms.


12. Memberships and Recurring Billing — Some memberships or plans renew automatically or continue until canceled. Before purchase, we disclose material recurring-payment terms including charge amount and frequency, renewal nature, and cancellation terms. By purchasing after reviewing those disclosures, you authorize charges according to the disclosed schedule until cancellation or termination. We provide notices and online cancellation methods where required by law. Cancellation generally prevents future recurring charges but does not automatically refund properly charged amounts except as required by law or the Membership Agreement, which controls if applicable.


13. Statutory Membership Cancellation Rights — Nothing waives or limits any cancellation, refund, relocation, disability, death, rescission, or other rights provided by applicable law. Relevant statutory notices and cancellation rights are provided through the Membership Agreement where required.


14. Membership Freezes and Pauses — If offered, eligibility, duration, fees, notice requirements, and conditions are set out in the applicable Membership Agreement or membership policy. A freeze is effective only when processed under that policy.


15. Refunds — Except where stated in purchase terms or required by law, completed purchases are non-refundable. If Harmonia cancels a class and does not provide a reasonable replacement or return the class credit, we may provide an account credit or refund where appropriate. Retail returns, if permitted, follow the policy provided at purchase.


16. Promotions and Introductory Offers — Promotions, discounts, referral credits, complimentary classes, and similar offers may have separate eligibility requirements and expiration dates. Unless otherwise stated, offers have no cash value, may not be combined, may be limited to one per person, and may be restricted to new clients. Harmonia may discontinue or modify future promotions and may cancel benefits obtained through fraud, duplicate accounts, misrepresentation, or abuse.


17. Gift Cards — Gift cards or certificates, if offered, are subject to terms disclosed at purchase and applicable California law and may not be redeemed for cash except as required by law.

18. Studio Conduct — Clients and guests must behave respectfully and safely. You agree not to harass, threaten, intimidate, discriminate, engage in unsafe behavior, intentionally damage property, disrupt class, misuse equipment, photograph or record others without permission, engage in unlawful conduct, or interfere with an instructor’s ability to conduct class safely. Harmonia may refuse service, remove an individual, suspend booking privileges, or terminate a membership for conduct creating a safety concern, materially disrupting operations, or violating these Terms or studio policies, subject to law.


19. Personal Belongings — You are responsible for personal property at the studio. To the fullest extent permitted by law, Harmonia is not responsible for lost, stolen, misplaced, or damaged belongings unless liability cannot legally be excluded.


20. Photography and Recording — Clients may not photograph, film, or record instructors, employees, other clients, or classes without permission. Harmonia will not use an identifiable client’s image, voice, or likeness solely because they accepted these Terms; separate permission or a photo/video release may be requested for marketing use.


21. Intellectual Property — The Site and Harmonia-owned content, including brand names, logos, trademarks, text, graphics, class descriptions, photographs, videos, designs, and other materials, are owned by Harmonia Pilates LLC or used under license. You may access Site content for personal, non-commercial use only and may not copy, reproduce, modify, distribute, sell, publish, commercially exploit, or create derivative works except as expressly permitted.


22. User-Submitted Content — You retain ownership of content you own. When you intentionally submit content for public display, you grant Harmonia a non-exclusive, royalty-free license to host, reproduce, and display it for that purpose. This does not automatically authorize paid advertising use of your identifiable photograph or likeness. We may remove content that violates these Terms, infringes rights, or is inappropriate; you represent that you have the necessary rights to submit it.


23. Privacy — Use of the Site is also subject to our Privacy Policy, incorporated by reference.


24. Third-Party Platforms and Services — We may use third-party services for scheduling, membership management, payments, hosting, communications, analytics, and related business functions. Their use may be subject to their own terms and privacy policies; we are not responsible for independent acts or practices we do not control.


25. Payment Processing — Payments may be processed through third-party processors. Harmonia generally does not directly store complete payment-card information when providers collect and process it.


26. Site Availability — We aim for reliable access but do not guarantee uninterrupted, error-free availability. The Site may be unavailable because of maintenance, technical failures, third-party interruptions, security issues, or other circumstances, and we may modify or discontinue features.


27. Prohibited Use of the Site — You may not violate law; attempt unauthorized access; introduce malware; interfere with Site operation or security; scrape personal information unlawfully; impersonate another person; infringe rights; engage in fraud; or use the Site for unauthorized commercial solicitation.


28. Disclaimer of Warranties — To the fullest extent permitted by law, the Site and content are provided on an “as is” and “as available” basis. Harmonia does not warrant that the Site will always be uninterrupted, error-free, secure, or free of harmful components and does not guarantee particular outcomes from Services. Nothing disclaims a warranty that cannot lawfully be disclaimed.


29. Limitation of Liability — To the fullest extent permitted by law, Harmonia Pilates LLC and its representatives are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from Site use. For claims arising solely from Site or digital Services, aggregate liability will not exceed the amount paid for the applicable Service during the six months preceding the event. Nothing limits liability that cannot legally be limited, including gross negligence, willful misconduct, fraud, or statutory consumer rights.


30. Indemnification — To the extent permitted by law, you agree to indemnify and hold Harmonia harmless from third-party claims resulting directly from intentional violation of these Terms, unlawful Site use, infringing submitted content, or fraudulent or intentionally wrongful conduct.


31. Suspension and Termination — You may stop using the Site at any time. Harmonia may suspend or terminate an account or Site access when it reasonably believes a user violated these Terms, engaged in fraud, created a safety concern, misused Services, or violated law. Termination does not eliminate properly incurred payment obligations.

32. Changes to These Terms — We may update these Terms from time to time. When changes are made, we will update the Last Updated date and make revised Terms available through the Site. If required by law, we will provide additional notice or obtain consent before material changes take effect. Changes apply prospectively and do not eliminate accrued rights.


33. Governing Law — These Terms are governed by California law, without regard to conflict-of-law principles, except where federal law applies. Nothing deprives consumers of non-waivable protections.


34. Dispute Resolution and Arbitration — PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Before formal proceedings, you and Harmonia agree to make a reasonable good-faith effort to resolve disputes informally; contact info@harmoniapilates.co. Except for matters eligible for small claims court and matters that law does not permit to be arbitrated, disputes relating to these Terms or Site use will be resolved through individual binding arbitration rather than a jury trial. Arbitration follows applicable consumer arbitration rules with a mutually agreed provider and may take place remotely or in San Francisco, California, subject to law. Harmonia pays arbitration fees as required by law or applicable rules. Class Action Waiver — To the fullest extent permitted by law, claims subject to arbitration must be brought individually and not as a plaintiff or class member in a class, collective, consolidated, or representative proceeding. If unenforceable for a claim, that claim proceeds in a court of competent jurisdiction rather than class arbitration unless agreed otherwise. Small Claims Court — Either party may bring a qualifying individual claim in small claims court. Right to Opt Out of Arbitration — You may opt out within 30 days after first accepting these Terms by emailing info@harmoniapilates.co with your full name, account email, and a clear statement that you wish to opt out. Opting out does not affect use of Harmonia’s Services.


35. Court Venue When Arbitration Does Not Apply — For claims not subject to arbitration and not brought in small claims court, the parties consent to jurisdiction of state and federal courts located in San Francisco County, California, except where consumer law requires otherwise.


36. Severability — If a provision is unlawful or unenforceable, it will be enforced to the maximum extent permitted or severed as necessary; remaining provisions continue.


37. No Waiver — Failure to enforce a provision once does not waive the right to enforce it later.


38. Assignment — You may not assign rights or obligations without written consent. Harmonia may assign these Terms in connection with a merger, acquisition, reorganization, asset sale, or similar transaction, subject to law.


39. Entire Agreement — These Terms, our Privacy Policy, and applicable purchase, membership, waiver, or program agreements govern the relevant Services. A specific Membership Agreement, Participant Waiver, or other agreement controls where it expressly conflicts.


40. Electronic Communications — By using the Site or providing an email address or telephone number, you may receive transactional communications relating to bookings, purchases, memberships, account activity, schedule changes, or similar matters. Marketing communications are subject to law and consent requirements, and you may unsubscribe using the method provided.
